Child sex defendant pleads no contest

Seven months after a jury
deadlocked in a bizarre sex assault trial in which the accused
introduced a shopping bag full of condoms in his own defense,
prosecutors offered the defendant a plea deal with no jail time.
Cary Simmang, originally tried on 14 counts of aggravated sexual
assault of two children, pleaded no contest to two counts Monday in a
case that highlights the difficulty of prosecuting allegations of child
sex abuse.
Deadlocked juries are not unusual in child sex
assault cases, where it often boils down to the word of a child against
the word of an adult, said prosecutor Catherine Babbitt of the Bexar
County district attorney's office.
“Sometimes juries feel like they would like more evidence than that,” Babbitt said.
The children are not being identified because it's the general policy
of the San Antonio Express-News not to identify alleged sex assault
victims.
