Video recordings of the defendant's telephone conversations in the police interview room were admissible because they were not wire communications under CCP art. 18.20. Words that are spoken into a telephone receiver and that can also be heard in the area surrounding the speaker without electronic assistance are not "wire communications" as defined in CCP art. 18.20, ยง1(1). The DVD was merely a recording of the defendant's side of the conversation and did not intercept any portion of the wire communication. Moseley v. State, PD-479-07.
