An alleged rape victim
described for jurors Tuesday an encounter with a man she said posed as
an off-duty police officer and led her to a home where he attacked her.
Testifying in the aggravated sexual assault trial of
Arthur Berkley, the 19-year-old woman said she thought her assailant
was going to kill her the morning of Nov. 26, 2006.
In
addition to the sexual assault charge, Berkley, 41, was indicted on
charges of kidnapping and impersonating a public servant.
Prosecutors contend Berkley posed as a police officer to intimidate and
rape the woman. The defense maintains the sex was consensual.
The woman had just had a noisy fight with her boyfriend that day and
stormed away from a party in Windcrest, prosecutor Chris DeMartino told
jurors on the first day of Berkley's trial.
