Moore v. State - 2nd COA

A trial court may not impose a sentence in excess of a plea-bargained punishment without allowing the defendant to withdraw his guilty plea when the defendant fails to return to court for sentencing after pleading guilty. The trial court may not impose a higher punishment because the plea bargain did not include an agreement to convert the plea to an open plea if the defendant did not appear for sentencing. The trial court may not impose a non-negotiated term on the plea bargain. Moore v. State, 2-06-125-CR [1].
