Court finds gang injunction constitutional

People who have worked on the Varrio Carnales Gang Injunction case were anxiously awaiting news that came this week from the Second Court of Appeals in Fort Worth — and the news was good for the city, the county and other areas when it comes to this type of action, the gang prosecutor for the city and county said.

“It’s a big deal,” Gang Prosecutor Robert Massey said. “They held in our favor on all of the issues.”

This provided the first bit of case precedent on the “gang injunction statute,” and indicates a nod from the court that the efforts are constitutional and beneficial, he said.

Franco Andre Goyzueta, now 20, received a 300-day jail sentence in 2007 related to a conviction stemming from a violation of the VC injunction. According to a September Times Record News report, Goyzueta was a passenger in a vehicle police pulled over in the VC “safety zone” about 12:45 a.m. April 14, 2007. His presence there at that time was a violation of the injunction, according to the article.
