79th JUDICIAL DISTRICT ATTORNEY’S OFFICE- NOTICE

JOB TITLE:  PROSECUTOR (ADA) – Border Prosecution Unit (BPU) Operation Lone Star (OLS) Prosecutor (Border Prosecution Unit grant funded position)

SALARY LEVEL:  Salary-$90,000 (excluding state longevity supplements for qualifying candidates), based on candidate’s prosecutorial and/or criminal justice litigation experience.  This position is funded by a grant through the Office of the Governor’s Homeland Security Grant Division and is administered through Jim Wells County and includes full-time benefits. 

SUMMARY The 79TH Judicial District Attorney’s Office, has an opening for an Assistant District Attorney-Border Prosecutor to prosecute felony crimes in Brooks and Jim Wells counties.  We are looking for an experienced and highly self-motivated hardworking assistant district attorney.  Salary is negotiable depending on experience plus benefits.  Bar dues and training will be paid for by the 79TH Judicial District Attorney’s Office.  Must be willing to submit to a criminal history check and sign a confidentiality agreement. 

This position requires a knowledge of all phases of criminal prosecution, law enforcement procedures and criminal trials/appeals.  The assistant district attorney-border prosecutor is responsible for the prosecution of adult felony offenders in the district courts.  This position requires an understanding of transnational criminal organizations and street gangs along the U.S./Texas-Mexico border region and into the state of Texas.  The assistant district attorney-BPU/OLS prosecutor is also responsible for trying cases and handling other criminal law matters such as appeals, writs of habeas corpus, expunctions, etc.

The Legislature has provided funding for the BPU to provide an attorney specifically dedicated to assisting with investigations and prosecutions of BPU/OLS caseloads within the BPU regions. The BPU/OLS Prosecutor is hired and supervised by the 79th Judicial District Attorney and will comply with the personnel policies set by Jim Wells County. 

  • Assist BPU offices within the region with the investigation, presentation and trial of felony cases.
  • Assist federal, state and local law enforcement agencies within the region with the preparation of search and arrest warrants and other legal documents.
  • Upon request by other District Attorneys outside the 79th Judicial District and with approval of the employing District Attorney, assist in other jurisdictions.
  • At the direction of the District Attorney, confer with local, state and federal law enforcement agencies to determine the best practices and policies in addressing the BPU/OLS caseload.
  •  Provide and/or facilitate training for all law enforcement agencies within the region on issues pertinent to the investigation and prosecution of BPU/OLS cases, and other such issues in criminal law and procedure as may be needed.
  • Coordinate and collaborate with BPU personnel in each of the other two BPU regions on investigations and prosecution of BPU/OLS cases.
  • Be available, as needed, to the BPU training director for assistance with training seminars in all BPU regions, with the permission of the employing elected District Attorney and secondary to his/her primary responsibilities of investigating, coordinating and prosecuting BPU/OLS cases.
  • Review and analyze all pre-indictment cases as to the elements of the offense and the evidence needed to meet the legal standard of probable cause to present the case to a grand jury and any additional information that is needed to successfully prosecute a case to trial.
  • Prepare and evaluate cases daily to ensure adequate investigation of all cases pursuant to the current law in Texas and the U. S.
  • Prepare for pre-trial hearings (motions for discovery, motions to suppress evidence, motions to revoke probation, etc.) weekly.
  • Be able to prepare an appellate brief and argue before any appellate court.
  • Professionally and competently represent the elected 79th Judicial District Attorney before the grand jury, in court, at trial and at any required community functions.
  • Be available 24 hours a day/7 days a week to assist law enforcement, when needed.
  • Be punctual and be able to work long office hours.
  • Perform legal research and writing daily.
  • Prepare for and conduct trials (bench or jury).
  • Prepare and evaluate cases daily. Ensure adequate investigation of cases. Apply law to presented facts.
  • Perform witness interviews; contact victims; contact law enforcement agency personnel.
  • Maintain up-to-date knowledge of law.
  • Obtain just convictions and appropriate punishment according to an application of current law to the facts of the case.
  • Screen incoming case reports from local agencies and present selected cases to the Grand Jury.
  • Answer questions from law enforcement agencies.
  • Follow all policies and procedures set forth by the 79th Judicial District Attorney. 
  • Travel within the 79th Judicial District and BPU region.

EDUCATION and/or EXPERIENCE:  Must be licensed to practice law in the State of Texas.  J.D. or L.L.B. degree from an accredited law school.  Three or more years of experience in criminal justice. Prior work experience as a prosecuting attorney preferred. 

LANGUAGE SKILLS:  Ability to read, analyze, and interpret common scientific and technical journals, financial reports, and legal documents.  Ability to respond to common inquiries from the public, regulatory agencies, and law enforcement entities.  Ability to effectively present information to top management and public groups.  Ability to speak and/or read Spanish preferred.
