Code of Criminal Procedure – (2024 interim edition)

TDCAA’s spiral-bound Code of Criminal Procedure (and Penal Code) are the only criminal code books that feature underline/strikethrough format with the most recent legislative changes, annotations to help explain court interpretation of the statutes, commentary from ­prosecutors who spent their time at the capitol, and ­spiral binding that allows the book to lie open flat.

While typically, TDCAA only publishes new editions of the CCP following a regular legislative session, we have published an interim edition for 2024. This edition first came about because of larger-than-usual output from the Texas Legislative Council’s ongoing code revision project, which made significant changes to five chapters of the CCP that become effective Jan. 1, 2025.

In the 2023 session, the code revision project tackled re-writing Chapters 2 (General Duties of Officers), 13 (Venue), 31 (Change of Venue), 45 (Justice and Municipal Courts), and 55 (Expunction of Criminal Records) of the CCP into new Chapters 2A, 2B, 13A, 31A, 45A, and 55A. The result was HB 4504 (effective Jan. 1, 2025), a 332-page bill that renumbers, reorganizes and updates those chapters with the goal of making them more logical and coherent without intending any substantive changes.

This book also includes the substantive changes to the remnants of Chapters 2, 13, 31, 45, and 55, and although the numbering scheme will lead to some confusing citations, all the changes made to those chapters will still be good law after January 1, 2025 (see Code Construction Act, Tex. Gov’t Code Ch. 311).

We have also included changes to the Code of Criminal Procedure from SB 4, passed in the 4th Special Session of 2023. This bill enacted a new chapter of the Texas Penal Code and Code of Criminal Procedure and amended other statutes in the Code of Criminal Procedure and Government Code, effective March 5, 2024. Note, however, that at press time for this book, the federal courts are considering whether these new immigration laws can be enforced.

TDCAA will return to its regularly scheduled publishing program in the summer of 2025, with new editions of all our code books that incorporate changes made in the 89th Legislative Session.
